1. Definitions

“Seller” means Giftio s.r.o.

“Buyer” means any person purchasing goods on the Seller’s online store.

“Goods” means products offered for sale.

“Total Price” means the price of the Goods including VAT (if applicable) and any delivery charges shown at checkout.

“EU Consumer” means a natural person acting outside their trade, business, craft, or profession, with delivery to an EU member state.
2. Scope
These Terms govern purchases made through the Seller’s online store. By placing an order, the Buyer agrees to these Terms. If a specific agreement made during checkout conflicts with these Terms, that specific agreement prevails for the respective order.
3. Prices, Currency & Taxes
3.1. Prices are displayed and charged in EUR only.
3.2. Prices include VAT where applicable according to the place of supply rules.
3.3. Any import duties, customs clearance fees, brokerage charges, and taxes outside the EU are borne by the Buyer.
4. Payment
4.1. Payment in advance only.
4.2. Accepted methods: PayPal (including card payments processed via PayPal).
4.3. The order is processed only after successful payment authorization and receipt.
5. Order Process & Contract Formation
5.1. Placing items in the cart and completing checkout constitutes an offer by the Buyer.
5.2. The Seller will confirm receipt of the order by email. The contract is formed when the Seller explicitly accepts the order (order confirmation) or dispatches the Goods.
5.3. Obvious pricing errors: If a price is manifestly incorrect (e.g., missing digit), the Seller is not obliged to supply at that price. The Buyer will be informed and may accept the corrected price or cancel without charge.
6. Delivery & Risk
6.1. Delivery is available to selected EU countries and selected worldwide destinations. For details, contact the Seller.
6.2. Delivery times are estimates and may vary by destination, product availability, and carrier capacity.
6.3. Risk of loss or damage passes to the Buyer upon delivery to the delivery address or to the first carrier if delivery failed due to Buyer’s fault (e.g., refusal or no-show after reasonable attempts).
6.4. Title to Goods passes upon full payment and delivery.
6.5. If redelivery or alternative delivery is required for reasons attributable to the Buyer, the Buyer bears the associated additional costs.
7. Customs & Import
7.1. For deliveries outside the EU, all customs duties, taxes, and clearance fees are the Buyer’s responsibility and may be collected by the carrier or customs.
7.2. The Seller is not responsible for delays caused by customs procedures.
8. Right of Withdrawal (EU Consumers Only)
8.1. EU Consumers have the right to withdraw from the contract within 14 days without giving any reason. The period starts on the day the Buyer (or a third party indicated by the Buyer) takes delivery of the Goods; for multiple items/parts, from the delivery of the last item/part; for subscriptions/regular deliveries, from the first delivery.
8.2. To exercise the right, the EU Consumer must send a clear statement of withdrawal within the 14-day period.
8.3. The EU Consumer must return the Goods within 14 days after notifying withdrawal. Return shipping costs are borne by the Buyer.
8.4. The Seller will refund the product price and the original delivery cost up to the cost of the least expensive offered delivery method, within 14 days of a valid withdrawal, but not before receiving the Goods back or proof of return shipment.
8.5. The EU Consumer is liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Goods (as in a retail store).
8.6. Legal exclusions from withdrawal apply (e.g., made-to-order/custom goods, sealed goods not suitable for return for health/hygiene reasons once unsealed, and other cases under applicable law).
9. Conformity & Warranty
9.1. The Seller warrants that the Goods conform at delivery to the contract description, quantity, and quality.
9.2. Warranty period: 24 months from delivery for consumers, subject to statutory conditions.
9.3. The warranty does not cover wear and tear, improper use, accidental or deliberate damage, or issues caused by the Buyer’s failure to follow instructions.
9.4. Claims procedure: The Buyer should notify the Seller without undue delay, describe the defect, and follow the instructions for return/inspection.
9.5. Remedies: Repair or replacement (where proportionate), or where not possible/appropriate, a reasonable price reduction or contract termination with refund, in accordance with applicable law.
9.6. The Seller aims to handle consumer complaints within 30 days of receipt of the claim, unless a longer period is required by the nature of the Goods or the defect (the Buyer will be informed).
10. Accounts (If Offered)
10.1. An account (if available) is personal and protected by a password. The Buyer is responsible for keeping access credentials confidential and for all activities under the account.
10.2. The Seller may suspend or close an account in case of breach of these Terms or misuse.
11. Reviews
The store does not publish product reviews.
12. Force Majeure
Neither party is liable for non-performance caused by events beyond reasonable control (including but not limited to natural disasters, pandemics, strikes, carrier failures, supplier outages, governmental actions). If such event lasts over 10 days, either party may cancel the affected order; any amounts paid for undelivered Goods will be refunded.
13. Changes to the Terms
The Seller may update these Terms prospectively. Orders placed before the effective date of a change remain governed by the Terms in effect at the time of the order.
14. Dispute Resolution & ODR (EU)
14.1. The Seller will first seek an amicable resolution with consumers.
14.2. EU consumers may use the EU Online Dispute Resolution (ODR) platform for disputes arising from online purchases.
14.3. Mandatory consumer rights and remedies under applicable consumer law remain unaffected.
15. Governing Law & Jurisdiction
15.1. These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them are governed by the laws of the Slovak Republic.
15.2. Courts of the Slovak Republic shall have jurisdiction. If the Buyer is a consumer, mandatory protections granted by the law of the Buyer’s habitual residence in the EU are preserved.
16. Communication
All order-related communications will be conducted electronically using the contact details provided during checkout.
